In Kinovorstellungen dürfen grundsätzlich nur Filme gezeigt werden, die für eine bestimmte Altersgruppe ausdrücklich zugelassen sind. Die Theaterbetriebe sind verpflichtet , das Freigabealter gut sichtbar auszuhängen und nur Kinobesuchern Einlass zu gewähren, die das freigegebene Alter erreicht oder überschritten haben.
Diese Beschränkung gilt nicht nur für den vorgeführten Hauptfilm, sondern für sämtliche Vorführungen in der betreffenden Vorstellung, folglich auch für Werbefilme, Werbevorspannfilme, Kurzfilme u. a..
Die Freigabe erfolgt durch die Freiwillige Selbstkontrolle der Filmwirtschaft mit Sitz in Wiesbaden (FSK).

Aufgabenbereiche der FSK:
Die Obersten Landesbehörden sind nach § 6, 7 des Gesetzes zum Schutze der Jugend in der Öffentlichkeit (Jugendschutzgesetz JÖSchG) vom 25. 02.85 zuständig für die Entscheidung über die Freigabe und Kennzeichnung von Filmen zur öffentlichen Vorführung vor Kindern und Jugendlichen sowie von Videokassetten und vergleichbaren Bildträgern, die Kindern und Jugendlichen in der Öffentlichkeit zu-gänglich gemacht werden. Die obersten Landes-behörden bedienen sich gemäß Vereinbarung der Länder über die Freigabe und Kennzeichnung von Filmen, Videokassetten und vergleichbaren Bild-trägern der Prüftätigkeit der Ausschüsse der Filmwirtschaft - Jugendprüfstelle (FSK/J) als gutachterliche Stelle.
Die Ausschüsse der FSK sind fachkundig, sachverständig, unabhängig und gesellschaftlich repräsentativ besetzt. Sie werden für die Jugend- und Feiertagsfreigabe von der Filmwirtschaft und den hieran fachlich beteiligten Gruppen der öffentlichen Hand bestellt, wobei zur Wahrung des gesetzlichen Auftrags auf diesen Gebieten die Delegierten der öffentlichen Hand die Majorität in den Ausschüssen besitzen.
Altersfreigabe
Die im Kino gezeigten Werbefilme müssen vor ihrem Einsatz der FSK zur Prüfung vorgelegt werden. Die FSK entscheidet über die altersgerechten Einsatzmöglichkeiten mit folgenden
FSK-Freigaben:
- freigegeben ohne Altersbeschränkung
- freigegeben ab 6 Jahre
- freigegeben ab 12 Jahre
- freigegeben ab 16 Jahre
- freigegeben nicht unter 18 Jahre.
Den zu versendenden Werbefilmen muss eine entsprechende Altersfreigabekarte (FSK-Karte) beigefügt werden.
Anspruch auf Vorführung von Werbefilmen zu allen Vorstellungen besteht nur, wenn eine Freigabe "ohne Altersbeschränkung" vorliegt.
Formulare für Prüfungsanträge sind erhältlich bei der FSK in Wiesbaden oder bei den Werbeverwaltungen und Spezialmittlern für Kinowerbung.
Tonnormprüfung
Im Rahmen der Prüfung zur Altersfreigabe muss die Tonnorm mitgeprüft werden. Grundlage der Prüfung ist die Kinowerbefilm Tonnorm des FDW in der jeweils gültigen Fassung. Der Tonstandard wird auf der FSK-Karte vermerkt.

Die Prüfgebühren sind der jeweils gültigen Prüfkostenordnung zu entnehmen.
Prüfungsunterlagen
Neben dem vollständig ausgefüllten Prüfungsantrag benötigt die FSK eine 35mm-Kopie zur
Ansicht. Die Einreichung von Videokopien ist nicht möglich.
Zeitrahmen
Obwohl FSK-Prüfungen schnell und unbürokratisch abgewickelt werden, sollte bei der Produktion ein Zeitraum von mindestens 14 Tagen für die Sichtung/ Entscheidung und den Versand der benötigten FSK-Freigabekarten einkalkuliert werden.

FSK - approval for cinema advertising films
Only films which have been expressly approved for a specific age group can be shown in cinemas. The cinema operator is obliged to clearly and visibly indicate the approval age and only allow cinema entry to those persons who have reached or exceed the approved age. This restriction applies not only to the shown feature film but also to all the other films shown during the same performance and consequently also to trailers, advertising films and footage, etc. The age approval occurs via the ?Freiwillige Selbstkontrolle der Filmwirtschaft (Voluntary Selfcensorship organisation of the German Film Industry) located in Wiesbaden.

Function of the FSK
According to § 6 and 7 of the law for the protection of adolescents in public areas (Jugendschutzgesetz JÖSchG) of 25.02.85, the Upper State Authorities are responsible for the decision in respect of the approval and identification of films for public showing in front of children and adolescents and of video cassettes and similar picture media which are made publicly accessible to children and adolescents. In accordance with the inter-state agreement concerning the approval and identification of films, video cassettes and similar picture media, the Upper State Authorities make use of the examination activity of the adolescent approval committees of the film industry (FSK/J) as advisory body.
The members of the FSK committees are competent, qualified, independent and represent the cross-section of the society. They are contracted for the adolescent/holiday approval examination by the film industry and the relevant public administration groups. The observance of the statutory responsibility is ensured in that the delegates of the public authority form the majority in the committees.
Age approval
Advertising films which are to be shown in cinemas must be submitted to the FSK for approval before their use. The FSK decides on the age-appropriate possibilities of use according to the following FSK approvals:
- approved without age restriction
- approved for persons of no less than 6 years of age
- approved for persons of no less than 12 years of age
- approved for person of no less than 16 years of age
- approved for persons of no less than 18 years of age
The advertising films to be sent must be accompanied by an appropriate age approval card (FSK card).
A right to have the film shown to any audience only exists when an "approval without restriction" is available.
Forms for examination requests can be obtained from the FSK in Wiesbaden or from the advertising administrations and special agents for cinema advertising.
Sound standard examination
The sound standard must be checked as part of the age approval examination. The basis of the check is the latest version of the cinema advertising film sound standard of the FDW. The sound standard is noted on the FSK card.
Examination fees
Please refer to the currently valid examination fee publication in order to ascertain examination fees.
Examination documentation
The FSK requires a 35mm print for viewing in addition to the completely filled-out examination request form. The submission of video copies is not possible.
Time frame
Although FSK examinations are completed quickly and unbureaucratically, a time frame of at least 14 days for the viewing/decision and the sending of the required FSK approval cards should be planned in during the production.
